Supreme Court: Affirmative Action Upheld The Supreme Court votes on June 23, 2016 in a 4–3 decision that affirmative action is legal under the equal protection clause and should be upheld in the case of Fisher v. University of Texas at Austin. The case was brought to the courts after a white female, Abigail Fisher, was rejected from the school in 2008. She believes that UT at Austin’s method of race consideration does not meet the standards previously set by the Supreme Court and challenges the use of affirmative action in higher education.
